RoofHunter ("the Service"), provided by Flocality LLC, generates roofing prospect lists and reports for roofing contractors ("you"). Each lead is a home that the Service's analysis suggests may be due for roofing work, with an estimated roof age, size, replacement price and related information. Leads are estimates, not facts, and are provided to help you decide whom to contact. They are not a promise that any homeowner wants or needs work.
You sign in with your email. You are responsible for activity under your account. Leads are purchased as prepaid credits in packs; one credit is spent when you accept a lead. Credits are non-refundable and expire twelve months after purchase. Prices are shown before purchase and may change for future purchases. Free trial credits are granted at Flocality LLC's discretion.
When you accept a lead, the Service will not offer the same home to another RoofHunter customer for sixty days. Exclusivity applies only within the Service; it does not prevent the homeowner from contacting any contractor or other contractors from finding the home by other means.
You will use leads only for your own roofing business, comply with all laws that apply to contacting homeowners (including door-to-door solicitation ordinances, do-not-call rules, consumer protection and home improvement contractor registration laws), and make only truthful statements to homeowners. You will not resell, share or publish leads or reports, scrape the Service, or attempt to learn or reproduce how leads are generated. Reports you show homeowners carry your company's name; you are responsible for their accuracy to the extent you edit or represent them.
Estimated roof age, size, condition, storm exposure and price are generated from aerial measurement and property data and may be wrong. You must confirm them by inspection before quoting or contracting. Flocality LLC is not a party to any agreement between you and a homeowner.
Homeowner details that you or a homeowner enter into the Service (such as a name and phone number submitted through a report page) are stored for your use and sent to you. See the Privacy Policy. You will handle such information lawfully.
The Service depends on third-party data and may be unavailable or inaccurate at times. Flocality LLC may change features, coverage areas and prices. Credits already purchased remain usable for their term.
The Service is provided "as is". To the fullest extent permitted by law, Flocality LLC disclaims all warranties and is not liable for indirect, incidental or consequential damages, or for any amount exceeding what you paid Flocality LLC in the twelve months before the claim.
Flocality LLC may suspend or close accounts that breach these terms. You may stop using the Service at any time; unused credits are forfeited on closure for breach.
These terms are governed by the laws of the State of New Jersey, and disputes will be brought in its courts, unless Flocality LLC designates otherwise in writing.
